The property sheet

Introduction

The property sheet is an official document that contains the most important data, owners and encumbrances of a property, such as the registered mortgage.

The property sheet is part of the real estate register, which is public and which contains the legally defined data of all real estates in the country for each property (thus the numerical data of the real estate, the data of the owner, as well as the rights and legally significant facts relating to the real estate – considering the latter data, the register is public, i.e. authentically certifies that the registered rights and facts exist).

The data is entered on the property sheet. Each property sheet has a number, which in the electronic real estate register is the same as the topographical number of the property, and the name of the settlement is also indicated on it. Anyone can request the property sheet, free of charge in a limited number per year.

Parts of the property sheet

The property sheet consists of three parts:

– The I. section contains the name and numerical data of the property: the topographical number, address, size of the area, the intended nature of the property (for example, apartment, resort, commercial building) or its legal nature (for example, condominium, mine plot, national or local protected building), for land, the field of cultivation and the quality class of the land. The land easement and land use rights of the previous owner of the property are also indicated here.

– The II. section contains the ownership information, for state assets, the data of the asset manager. You can see the name of the owner(s), their share of ownership and the title of ownership.

– The III. section contains other rights and facts regarding the property. Here, the encumbrances and restrictions of the property (the right of mortgage, the right of execution, usufruct and maintenance, etc.), the initiation of legal proceedings related to the property, the limitation of the rights of the owner (for example, the prohibition of alienation and encumbrance, which banks often impose to secure the mortgage are registered; the right to purchase, the prohibition of construction and land development, the utility service provider’s right of connection to real estate.

Get a property sheet

The contents of the property sheet can be viewed by anyone who proves their identity. The provision of data – as well as the management of real estate registers and the handling of matters related to real estate – is the responsibility of the territorially competent land offices. (These currently operate within the framework of the land registry departments and departments of the Budapest and county government offices – the latter cover one or more districts.)

A paper-based certified copy of the property sheet – upon request or inquiry – is provided by the land offices. An authentic copy of the property sheet can also be requested at the government customer service (in Hungarian: „kormányablak”). Notaries can also issue a certificate of the content of the property sheet, which has the same effect as the authentic copy of the property sheet.

A copy of the property sheet can be requested

– review, which only includes existing entries and

– a complete copy, which includes all existing and deleted entries on the property.

As an electronic document, an authentic copy of the property sheet can be requested from the computerized real estate registration system: for individuals, within the framework of the online service of the land office, with customer gatekeeper or KAÜ (Central Identification Agent) identification. It is an electronic document with an authentication clause, which is only authentic electronically, not printed. Therefore, if an authentic copy of the title deed must be submitted on paper in some official matter, it can only be requested in person at any land registry office.

Various user groups – such as lawyers, notaries, bailiffs, liquidators, financial institutions, municipalities, real estate offices or other companies – can compulsorily or optionally join the TakarNet land office computer system, from which they can request copies of property documents for their clients and for their work, and use other services. they can buy..

The request fee for a paper-based copy of an authentic title deed with security features is HUF 6,250 per property, and for a map copy (site plan) HUF 3,000.

A HUF 3,000 data service fee must be paid for an authentic copy of the title deed provided as an electronic document, and HUF 3,000 for a map copy.

Private individuals can request an authentic copy of the title deed provided as an electronic document free of charge twice a year. In addition, HUF 3,000 must be paid per property. (Change from January 1, 2023, that the non-authentic copy of the property sheet and map, which cost HUF 1,000 and 2,250 to download, respectively, will no longer be available, only a certified copy can be requested, at a higher price.)

The request for a copy of the property sheet is free of charge for the application of non-refundable state aid for the construction, purchase or extension of the apartment, once a year on behalf of the applicant to the credit institution.

In many other cases, the e-authentic copy of the property sheet may be free of charge, including for inheritance, guardianship, expropriation, share ownership or termination of undivided common property, as well as for the conduct of certain administrative authority, court and prosecution procedures. State and church organizations enjoy a personal exemption from the payment of fees (the latter can request the property sheets of their properties once a year for free).

How is a mortgage right on the property sheet?

You can register a mortgage on the property sheet of the property

– when the crediting financial institution disburses a home loan or other property-secured loan and loan,

– as security for an employer’s or local government’s employer or local government loan,

– the state for ten years until the condition of CSOK support is met,

– the tax office in case of customs and tax debt,

– public utility providers in case of debt, or

– private individual as collateral for a loan transaction.

How much does it cost to register and delete a lien from the title page?

The fee for most land registry procedures (including the cancellation of the mortgage) costs HUF 6,600 per property, but the fee for the registration of the mortgage right and the amendment of the registration is HUF 12,600 per property.

The fee for the extraordinary procedure requested by the client is HUF 10,000/property.
